<br /><span style="background-color: white; font-family: Verdana, Arial, Helvetica, sans-serif; font-size: 11px; line-height: 18px;">The National Institute of Standards and Technology (NIST) is an agency of the </span><a href="http://www.commerce.gov/" style="background-color: white; color: #362bb6; font-family: Verdana, Arial, Helvetica, sans-serif; font-size: 11px; line-height: 18px; text-decoration: none;">U.S. Department of Commerce</a><span style="background-color: white; font-family: Verdana, Arial, Helvetica, sans-serif; font-size: 11px; line-height: 18px;">.</span><br /><br /><img alt="AML entrance at night" height="394" src="http://www.nist.gov/images/aml_cropped.jpg" width="640" /><br /><div style="background-color: white; color: #333333; font-family: georgia, 'times new roman', times, serif; font-size: 1.4em; line-height: 1.5em; margin-bottom: 1em;">SAN FRANCISCO — The federal agency charged with recommending cybersecurity standards said Tuesday that it would reopen the public vetting process for an encryption standard, after reports that the National Security Agency had written the standard and could break it.</div><div style="background-color: white; color: #333333; font-family: georgia, 'times new roman', times, serif; font-size: 1.4em; line-height: 1.5em; margin-bottom: 1em;">“We want to assure the I.T. cybersecurity community that the transparent, public process used to rigorously vet our standards is still in place,” <a href="http://www.nist.gov/index.html" target="_blank">The National Institute of Standards and Technology</a> said in a <a href="http://www.nist.gov/director/cybersecuritystatement-091013.cfm" style="color: #666699;">public statement.</a>“N.I.S.T. would not deliberately weaken a cryptographic standard.”</div><div style="background-color: white; color: #333333; font-family: georgia, 'times new roman', times, serif; font-size: 1.4em; line-height: 1.5em; margin-bottom: 1em;">The announcement followed <a href="http://www.nytimes.com/2013/09/06/us/nsa-foils-much-internet-encryption.html?pagewanted=all" style="color: #666699;">reports published by The New York Times, The Guardian and ProPublica last Thursday</a> about the N.S.A.’s success in foiling much of the encryption that protects vast amounts of information on the Web. </div><div style="background-color: white; color: #333333; font-family: georgia, 'times new roman', times, serif; font-size: 1.4em; line-height: 1.5em; margin-bottom: 1em;">The Times reported that as part of its efforts, the N.S.A. had inserted a back door into a 2006 standard adopted by N.I.S.T. and later by the International Organization for Standardization, which counts 163 countries as members.</div><div style="background-color: white; color: #333333; font-family: georgia, 'times new roman', times, serif; font-size: 1.4em; line-height: 1.5em; margin-bottom: 1em;">For encryption to be secure, the system must generate secret prime numbers randomly. That random number generation process — which is based on mathematical algorithms — makes it practically impossible for an attacker, or intelligence agency, to predict the scrambling protocols that would allow it to unscramble an encrypted message.</div><div style="background-color: white; color: #333333; font-family: georgia, 'times new roman', times, serif; font-size: 1.4em; line-height: 1.5em; margin-bottom: 1em;">But internal memos leaked by a former N.S.A. contractor, Edward Snowden, suggest that the N.S.A. generated one of the random number generators used in a 2006 N.I.S.T. standard — <a href="http://web.archive.org/web/20060930163233/http://csrc.nist.gov/publications/nistpubs/800-90/SP800-90_DRBG-June2006-final.pdf" style="color: #666699;">called the Dual EC DRBG standard</a> — which contains a back door for the N.S.A. In publishing the standard, N.I.S.T. acknowledged “contributions” from N.S.A., but not primary authorship.</div><div style="background-color: white; color: #333333; font-family: georgia, 'times new roman', times, serif; font-size: 1.4em; line-height: 1.5em; margin-bottom: 1em;">Internal N.S.A. memos describe how the agency subsequently worked behind the scenes to push the same standard on the International Organization for Standardization. “The road to developing this standard was smooth once the journey began,” one memo noted. “However, beginning the journey was a challenge in finesse.”</div><div style="background-color: white; color: #333333; font-family: georgia, 'times new roman', times, serif; font-size: 1.4em; line-height: 1.5em; margin-bottom: 1em;">At the time, Canada’s Communications Security Establishment ran the standards process for the international organization, but classified documents describe how ultimately the N.S.A. seized control. “After some behind-the-scenes finessing with the head of the Canadian national delegation and with C.S.E., the stage was set for N.S.A. to submit a rewrite of the draft,” the memo notes. “Eventually, N.S.A. became the sole editor.”</div><div style="background-color: white; color: #333333; font-family: georgia, 'times new roman', times, serif; font-size: 1.4em; line-height: 1.5em; margin-bottom: 1em;">Cryptographers have long had mixed feelings about N.I.S.T.’s close relationship with the N.S.A., but many said last week’s revelations had confirmed their worst fears and eroded their confidence in N.I.S.T. standards entirely.</div><div style="background-color: white; color: #333333; font-family: georgia, 'times new roman', times, serif; font-size: 1.4em; line-height: 1.5em; margin-bottom: 1em;">“We’ll have to re-evaluate that relationship,” Matthew D. The National Security Agency (N.S.A.) participates in the N.I.S.T. cryptography process because of its recognized expertise. Zoe Lofgren (D-California) and Sen. Ron Wyden (D-Oregon) introduced Thursday the latest version of “Aaron’s Law,” a proposal the congresswoman started putting together earlier this year in an attempt to bring reform to the Computer Fraud and Abuse Act of 1986.<br /><br />Lofgren announced on the website Reddit in January that she was aiming to make changes to the CFAA in honor of Swartz, who committed suicide just days earlier while awaiting trial for a computer hacking case that could have ended with a sentence of several decades if he was found guilty. Swartz, who helped program Reddit and a number of other projects, was charged by federal prosecutors with accessing thousands of academic journal articles from the website JSTOR without authorized permission. He was only 26 years old when he took his life on January 11.<br /><br />“Aaron did not commit suicide but was killed by the government,” father Robert Swartz said during his son’s funeral service. “Someone who made the world a better place was pushed to his death by the government.”<br /><br />In the wake of his passing, Lofgren asked for help in drafting changes to the CFAA that would ensure others like Swartz won’t stand in the face of similar sentences for nonviolent computer crimes. On Thursday, both Lofgren and Wyden co-authored an article on Wired.com introducing “Aaron’s Law Act of 2013” and explaining why they say reform must occur.<br /><br />“The CFAA is a sweeping Internet regulation that criminalizes many forms of common Internet use,” they wrote. “It allows breathtaking levels of prosecutorial discretion that invites serious abuse. As Congress considers policies to preserve an open Internet as a platform for ideas and commerce, reforming the CFAA must be included.”<br /><br />“As written, the CFAA makes it a federal crime to access a computer without authorization or in a way that exceeds authorization. Confused by that? You’re not alone. Congress never clearly described what this really means. As a result, prosecutors can take the view that a person who violates a website’s terms of service or employer agreement should face jail time,” the lawmakers wrote.<br /><br />In January, Lofgren posted on Reddit that “There’s no way to reverse the tragedy of Aaron’s death, but we can work to prevent a repeat of the abuses of power he experienced.”<br /><br />“The government was able to bring such disproportionate charges against Aaron because of the broad scope of the Computer Fraud and Abuse Act (CFAA) and the wire fraud statute. It looks like the government used the vague wording of those laws to claim that violating an online service’s user agreement or terms of service is a violation of the CFAA and the wire fraud statute,” she wrote.<br /><br />“Using the law in this way could criminalize many everyday activities and allow for outlandishly severe penalties,” Lofgren said.<br /><br />This week, Lofgren and Wyden wrote that they’ve settled on a proposal that could reverse all of what they say is wrong with the CFAA. If enacted, they said, Aaron’s Law would protect “commonplace online activity from overbroad prosecution and overly harsh penalties, while ensuring that real harmful activity is discouraged and fully prosecuted.”<br /><br />Specifically, Aaron’s Law would establish that mere breach of terms of service, employment agreements or contracts are not automatic violations of the CFAA, and would also eliminate part of the law that can subject an individual to duplicate charges for the same violation. Additionally, they hope to reform current provisions in an effort to bring greater proportionality to penalties imposed under the CFAA.<br /><br />“Currently, the CFAA’s penalties are tiered, and prosecutors have wide discretion to ratchet up the severity of the penalties in several circumstances — leaving little room for non-felony charges under CFAA,” they wrote for Wired. “For example, under current law a prosecutor can seek to inflate potential sentences by stacking new charges atop violations of state laws. Aaron’s Law would reform the penalty for certain violations to ensure prosecutors cannot seek to inflate sentences by stacking multiple charges under CFAA, including state law equivalents of CFAA, and torts (non-criminal violations of law).”<br /><br />In March, 27-year-old Andrew Auernheimer was sentenced to 41 months in federal prison for violating the CFAA because he operated a computer program that harvested publically available email addresses from the servers of telecom AT&T. He was convicted of accessing a computer without authorization under the CFAA, but sharpy condemned the law during his sentencing hearing.<br /><br />The CFAA, said Auernheimer, was written and approved by then-President Ronald Reagan “at a time when he was so senile” that he thought Hollywood’s interpretation of compute hackers was an accurate portrayal.<br /><br />“The access which I am charged with involves adding one to a number. It is simple arithmetic. Anybody with a Web browser could have done it. I respectfully say that this court's decision is wrong. And if you people understood what you were doing with the rule of law and the Constitution, you would feel shame,” he said.<br /><br />Lofgren and Wyden say, “The introduction of this legislation is just the beginning of a process needed to bring balance back to the CFAA.”<br /><br />“Today, there’s an entire generation of digitally-native young people that have never known a world without an open Internet and their ability to use it as a platform to develop and share ideas. It’s up to all of us to keep it that way.”

They raise the alarm bells towards the urgency to address the root cause of the problem -- in this case, a lack of international norms to govern the cyberspace, said experts participating in the World Peace Forum 2013 in Beijing on June 27-28.<br /><br />They also warned the scale of cyber theft is so large to the extent that it hurts national interests of many countries where the Internet has become an important infrastructure playing a significant role in such fields as economy, social development and national defense.<br /><br />Many countries are becoming increasingly vulnerable to cyber attacks, former U.S. ambassador to China J. Stapleton Roy said, noting the issue has become a focus of a large number of governments around the world.<br /><br />Besides, cyber security has become a major irritant in several bilateral relations, hurting mutual trust and friendship between countries, Roy said.<br /><br />Chen Xiaogong, a member of Foreign Affairs Committee of the National People's Congress, described cyber space as a new battle field, cautioning that if countries should allow cyber arms race to take place, it could cause consequences worse than a nuclear war.<br /><br />Acknowledging the urgency to contain the disordering of the cyberspace and set up relevant international norms, experts also expressed optimistic over the world community's ability to do so.<br /><br />Experts noted that China and the United States, the world's two largest economies, have put the issue of cyber security on top of their cooperation.<br /><br />Chinese President Xi Jinping and his U.S. counterpart Barack Obama highlighted the importance of cyber security in their summit earlier this month in the U.S. state of California.<br /><br />In the meantime, the two countries have been preparing a working group specialized in cyber security and they have agreed to hold high-level talks in July.<br /><br />However, the surprising revelation by Snowden of widespread hacking by U.S. National Security Agency in China's Hong Kong has caused grave concerns from Beijing.<br /><br />"The United States wants a quick solution to the problem and minimize its negative influence on U.S.-China relations," international relations professor Jia Qingguo of Peking University told Xinhua.<br /><br />"But the key lies in how much progress the two countries will achieve in July's strategic and economic dialogue. If they can make notable progress, Snowden's adverse impact on bilateral relations will be repaired pretty soon."<br /><br />The Chinese expert suggested Beijing and Washington try to find broader common grounds on cyber cooperation. There are things that happen on the net that are very intimate, which people are going to be loath to do if they feel there is somebody looking over their shoulder."<br /><br />Another concern that Berners-Lee raises is around the safety of the already collected information.<br />The web’s inventor spoke out before accepting a US$1.5 million joint engineering prize awarded by Queen Elizabeth to five men, who are considered to be the fathers of the internet, including Robert Kahn, Vint Cerf, Louis Pouzin and Marc Andreessen.<br /><br />Berners-Lee argues that internet freedom must be safeguarded against companies or governments trying to take over control.<br /><br />"When you make something universal … it can be used for good things or nasty things … we just have to make sure it's not undercut by any large companies or governments trying to use it and get total control," he said at the award ceremony.<br /><br />One of the award recipients, Google Vice-President Vint Cerf, suggested companies should come up with ways to go around the surveillance, such as developing encrypted web communication.<br /><br />Snowden blew the whistle on an NSA program called PRISM that collects correspondence and video conversations of foreigners using internet services like Google, Skype, Yahoo and Facebook.<br /><br />He also provided documents showing the intelligence agency collects data on phone calls handled by the major US telephone companies.<br /><br />On top of that the whistleblower exposed British spy agency GCHQ’s access to the global network of communications, storing calls, Facebook posts and internet histories, and revealed that it shares this data with the NSA.<br /><br />Snowden was charged with espionage by US federal prosecutors on Friday and currently remains in an airport limbo in Russia’s transit zone after he flew to Moscow’s Sheremetyevo Airport from Hong Kong.<br /><br />Snowden’s stopover in the transit zone could be prolonged indefinitely, as his passport, which was annulled by the US on Saturday, leaves him without the necessary documentation with which to travel, a source reportedly connected with Snowden told Interfax.
