2 Face Court-Martial in Naval Academy Assault Case

WASHINGTON — Two former Naval Academy football players accused of sexually assaulting a female midshipman at an off-campus party will face court-martial proceedings, the latest in a string of high-profile cases in the military that are drawing increased scrutiny from the Pentagon and Congress.

Eric Graham, left, is charged with abusive sexual contact and Joshua Tate with aggravated sexual assault in a 2012 episode.

The case stems from a “yoga and toga” party last year near the academy in Annapolis, Md., where the woman, then a 20-year-old second-year student, arrived intoxicated and later had sex with some of the players. In grueling testimony last month during a military hearing at the Washington Navy Yard, she said she had no memory of parts of the evening.

The day after the party, the woman testified, she learned via social media of the encounters with three players, who were subsequently charged with sexually assaulting her and making false statements. The investigation was stymied in part by the woman’s initial refusal to cooperate, academy officials said.

The superintendent of the academy, Vice Adm. Michael H. Miller, following an initial hearing known as an Article 32 hearing, referred two midshipmen, Eric Graham and Joshua Tate, to general court-martial. Mr. Graham is charged with abusive sexual contact and Mr. Tate with aggravated sexual assault. Both are charged with making false official statements. Admiral Miller did not refer charges against another midshipman, Tra’ves Bush, the third player accused.

Admiral Miller, who is what the military calls the “convening authority” in the case, made the highly unusual choice of pressing for courts-martial against the advice of the investigating officer, who oversaw the hearing and predicted the prosecution would fail to convict the three men.

Admiral Miller determined that there were not reasonable grounds for the charges against Mr. Bush, but that “reasonable grounds did exist to believe that the offenses were committed by Midshipman Graham and Midshipman Tate,” said John Schofield, a spokesman for the academy.

He added: “The convening authority decision is not based on the probability of a successful prosecution. Rather, it is the convening authority’s responsibility to independently evaluate evidence and determine if reasonable grounds exist that a crime has been committed by the accused.”

Andrew Weinstein, the lawyer for Mr. Bush, said he felt gratified. “Midshipman Bush is a young man who has committed his life to the protection of our country,” Mr. Weinstein wrote in an e-mailed statement, “and with these criminal charges now behind him, he looks forward to continuing his loyal and devoted service.”

Chip Herrington, the lawyer for Mr. Graham, said his client was “not guilty and the allegations of sex abuse against him are completely false.”

Pointing to the recommendation of the hearing investigator, Mr. Herrington said: “Obviously, we are disappointed with Vice Admiral Miller’s rejection of the recommendation of his own investigating officer. However, we believe we have the truth on our side.”

During the Article 32 hearing, the woman was aggressively grilled about her sexual habits, generating public outrage about the proceedings, which help determine whether cases are sent to court-martial. Article 32 hearings permit questions not allowed in civilian courts.

Susan Burke, the woman’s lawyer, said, “We’re pleased that the two men have been court-martialed,” although she was unhappy that one was not. “Despite the abusive Article 32 process,” Ms. Burke said, “the victim is strong and remains willing to testify at trial.”

Defense lawyers in the case may argue that the case be thrown out because of so-called unlawful command influence exercised by President Obama, who has called for sex offenders in the military to be punished severely. Mr. Obama, as commander in chief of the armed forces, is considered the most powerful person to wield such influence.

Several sexual assault cases across branches of the military have been thrown out or curtailed on such grounds. “We have no doubt that the president’s comments have had an influence with regard to the public pressure placed on Vice Admiral Miller,” Mr. Herrington said.

The problem of sexual assault in the military has increasingly alarmed Congress, which is considering changes to the system, including removing prosecutorial powers from commanders and perhaps re-examining the entire Article 32 process.

“Admiral Miller’s action does nothing to foster public confidence in the administration of justice in the armed forces,” said Eugene R. Fidell, who teaches military justice at Yale Law School. “His referral of charges against two individuals to a general court-martial in no way blunts the force of the compelling arguments for fundamental reform of the Article 32 process and the transfer of the charging power from commanders to military prosecutors entirely independent of the chain of command.”

As 2nd round of sequestration looms,Pentagon to bear brunt of upcoming budget cuts

WASHINGTON - A second,"deeper" round of automatic federal budget cuts is on its way,and it's going to hit the Pentagon hard.

Already reeling from a $34 billion budget blow this year due to deficit-driven spending reductions known as sequestration, the Defence Department would feel an additional $20 billion punch in 2014. All told, the Pentagon's budget for next year would be cut by about 10 per cent below levels approved just six months ago.

Domestic programs are spared further automatic budget cuts, a little-known wrinkle that could give Democrats some advantage in upcoming negotiations over repealing sequestration — or at least easing its effects.

That reality is beginning to dawn in the federal government, which allowed this year's $72 billion round of cuts to take effect. Officials have a few months to try to replace an even deeper round of cuts expected to take effect in January.

The situation is a product of the fallout of a budget law enacted two years ago that set up a deficit "supercommittee" with orders to come up with $1.2 trillion in deficit cuts over a decade. The law included the threat of the automatic cuts as a backstop intended to force a deal.

Sequestration was designed to be so painful that lawmakers would feel they had no choice but to act to prevent the automatic cuts. Instead, Congress managed to find only $24 billion in deficit cuts, leaving in place $72 billion in automatic spending reductions for 2013. About $17 billion of the automatic cuts came out of benefit programs — mostly from payments to Medicare providers. The other $55 billion was from the $1.043 trillion budget that Congress put together for day-to-day government operations. More than half of that goes to the Pentagon.

Democrats and President Barack Obama were the most anxious to reverse sequestration. Sensing that, GOP leaders were content to allow it to take effect.

The two sides have settled into a budget stalemate that shows no signs of easing — though talks between the White House and a handful of Senate Republicans have intensified in recent weeks.

Sen. John McCain, a leading Republican voice on national security issues, said he continues to work toward a budget deal that would end sequestration. But he's clearly frustrated over the lack of progress and says he couldn't predict success.

"The talks continue and continue and continue," the Arizona Republican said.

Some lawmakers and staff aides say the new, deeper reductions in the Pentagon's budget to could be the jolt that prompts lawmakers to step back from the automatic cuts.

"This is the primary motivator for undoing sequestration," said Jennifer Hing, spokeswoman for House Appropriations Committee Chairman Harold Rogers, R-Ky. "Defence will take an enormous hit and it will not be something they can absorb overnight."

The cuts are indeed daunting to the Pentagon, which has traditionally enjoyed sweeping bipartisan support from Congress and has seen its budget requests go mostly unchallenged during more than a decade of war in Iraq and Afghanistan.

Come January, however, the Pentagon faces a cut of $54 billion from current spending if Congress fails to reverse the automatic cuts, according to calculations by Capitol Hill budget aides. The base budget must be trimmed to $498 billion, with cuts of about 4 per cent hitting already reduced spending on defence, nuclear weapons and military construction. The roughly $78 billion budget for overseas military operations is exempt from sequestration.

Senior military officials have repeatedly warned about the devastating effects of the automatic cuts. Yet the Pentagon also appears resigned to the possibility that it will get no relief from sequestration and that defence hawks in Congress — outnumbered by GOP deficit hawks — will be unable to save the military budget.

The cuts would disproportionately hit modernization of aircraft, ships and weapons; operations and maintenance; training of the all-volunteer force; and health care. This is due in part because Obama exempted military personnel from the automatic cuts as well as additional money directed toward the war in Afghanistan.

Gen. Ray Odierno, the Army chief of staff, strongly suggested that the sequester could be deadly for U.S. military forces.

"What keeps me up at night is if I'm asked to deploy 20,000 soldiers somewhere, I'm not sure I can guarantee you that they're trained to the level that I think they should be over the next two or three years because of the way sequestration is being enacted," Odierno said in remarks Monday at the American Enterprise Institute. "We'll still send soldiers ... but they will not have been able to train collectively the way we would like. ... That means operations would take longer but, most importantly, it probably equals more casualties."

Congress has shown little inclination to undo the sequester, and many lawmakers seem content with cuts in defence spending as the United States cleans up after the war in Iraq and winds down another in Afghanistan.

The warnings from the military have largely gone unheeded.

"Frankly, I'm surprised because really bad things are happening to the military and it's doesn't seem to be having an effect here," McCain said.

"It is an allegation based on presupposition."

He continued, "The groundless accusations reflect U.S. distrust of China." The move is harmful to mutual trust between the two countries, he added.

In an information era, the international community is increasingly threatened by cyber security problems. Both China and the United States are victims of cyber crimes and should work together to tackle the issue, Wang said.

The researcher suggested that the first undertaking to forge a collaboration is to improve mutual trust rather than making false accusations; otherwise, more hostile actions will be expected in future.

Yao Yunzhu, another researcher at the academy, echoed Wang's opinion. She said that, as the world is entering a cyber era, making such false accusations is pointless.

"Instead, the United States and China should consider working together for an international cyber order that is fair to all and without prerogative," according to Yao.

She said military-to-military ties between China and the United States have been moving in a positive direction since last year, but groundless accusations will not be conducive to the momentum.

According to Yao, the act of publishing such a report on China is in itself not an action denoting goodwill, since it is not common practice for the United States to release a report on a single nation.

Also, the report tried to discredit China by saying the Asian country displays a lack of transparency over its military expenses and China's military development "serves more narrowly defined PRC interests and objectives, including advancing territorial claims."

It also accused China of cyber spying to gain information to benefit defense industries, military planners and government leaders.

Publishing an annual report full of such false accusations will have a negative impact on the building of military ties with China that are healthy, stable, reliable and continuous, a goal proposed by the U.S. side last year, Yao added.

Lawmakers from the left and right have expressed their disappointment in the findings, and only hours after the results were published Pres. Obama spoke of the issue during a conversation with Defense Secretary Chuck Hagel.

"I've directly spoken to Secretary Hagel already today and indicated to him that we not only have to step up our game but exponentially go after it," Obama said during a Tuesday presser.

One day earlier, Hagel called Air Force Secretary Michael Donley to voice his dismay over another report that has ravaged the Pentagon’s reputation as of late: over the weekend, Lt. Col. Jeff Krusinski of the Air Force’s Sexual Assault Prevention and Response Office was arrested for allegedly groping a woman in a suburban Washington, DC parking lot. According to a spokesperson with the Pentagon, Hagel called Donley on Monday to “express outrage and disgust,” and insisted the matter be dealt with “swiftly and decisively.”

"The American people, including our service members, should expect a culture of absolutely no tolerance for this deplorable behavior that violates not only the law, but basic principles of respect, honor, and dignity in our society and its military," Pentagon Press Secretary George Little said Tuesday. "Secretary Hagel is firmly committed to upholding the highest standards of behavior in America's armed forces and will take action to see this through."

So far this week, though, Hagel has had to weigh in twice in regards to the Pentagon’s snowballing sexual abuse problem. Following the release of the shocking numbers determined in this week’s Defense Department study, Hagel issued a new statement to declare "Sexual assault is a crime that is incompatible with military service and has no place in this department.”

“It is an affront to the American values we defend, and it is a stain on our honor,” added Hagel. “DoD needs to be a national leader in combating sexual assault and we will establish an environment of dignity and respect, where sexual assault is not tolerated, condoned or ignored."

Commenting on the accusations that Lt. Col. Krusinski drunkenly groped a woman in Northern Virginia over the weekend, Senate Armed Services Committee Chairman Carl Levin (D-Mich.) said, “This arrest speaks volumes about the status and effectiveness of the Department of Defense’s efforts to address the plague of sexual assaults in the military.”

The Pentagon has determined that the rate of female victims victimized in sexual assaults went from roughly 1-in-26 to 1-in-16 between the 2010 study and the most recent report. The actual number of incidents could be far greater, though, as other studies have suggested that accurate data in terms of Defense Department rapes is hard to get a hold of. Although 26,000 service members say they were sexually assaulted in 2012, the Pentagon officially counted only 3,374 formal allegations.
